Terms of Service

1. Service Description

PhysioSense, registered in Montenegro, is an educational reference platform for physiotherapy professionals and students. It provides access to extracted data from systematic reviews, guidelines, and regulatory sources — structured by diagnosis, role, and phase.

2. Medical Disclaimer

PhysioSense is NOT a system for clinical decision-making.

  • All content is for educational purposes only
  • The clinician always makes the final decision
  • Information does not replace professional assessment
  • Always consult a qualified healthcare professional

3. User Account

  • You must provide accurate information during registration
  • You are responsible for the security of your password
  • You must not share your account with others
  • Student pricing requires self-declaration of active student status. PhysioSense reserves the right to request proof of enrollment.
  • PhysioSense is intended for users aged 16 and over. Users under 16 may only use the platform with parental or legal guardian consent.
  • Your data is processed in accordance with our Privacy Policy and Cookie Policy.

4. Subscription and Payment

  • Free plan provides limited access (HomeSense module for 1 diagnosis)
  • Paid subscriptions are processed via Paddle (Merchant of Record)
  • Subscriptions auto-renew unless cancelled
  • You can cancel at any time in Settings — access continues until end of billing period
  • Early adopter prices remain locked while subscription is active

4a. Refund Policy

  • We offer a 14-day money-back guarantee from the subscription start date
  • To request a refund, contact support@physiosense.net within 14 days of payment
  • Refunds are processed through Paddle (Merchant of Record) and typically take 5–10 business days
  • Free tier: refund is not applicable
  • After 14 days: you may cancel at any time with no further charges; access continues until the end of the billing period
  • Refunds are issued to the original payment method via Paddle. PhysioSense does not process payments or refunds directly.
  • In accordance with EU consumer protection regulations, you have the right to withdraw from the subscription within 14 days of the start date without providing a reason.

5. Acceptable Use

You must not:

  • Use the platform for direct treatment decisions without professional assessment
  • Copy or redistribute platform content without permission
  • Attempt to access other users' data
  • Use automated tools to scrape content
  • Use the platform for commercial redistribution of extracted data
  • Violate any applicable laws or regulations
  • Create multiple accounts to abuse free tier or trial periods

6. Generated Reports

  • You retain full rights to use your generated reports
  • When you delete a report from your dashboard, it is removed from your view. Anonymized, non-identifiable data from reports may be retained for quality assurance and aggregate analytics purposes.
  • Upon account deletion, all personally identifiable report data is permanently erased within 30 days

6a. Data Processing on Behalf of Clinicians (Art. 28 GDPR)

When a clinician enters patient contact details (email and/or phone) into the intake wizard, PhysioSense acts as a data processor on behalf of the clinician, who is the data controller within the meaning of Art. 28 of the General Data Protection Regulation (GDPR).

Clinician responsibilities (data controller):

  • Ensure an appropriate lawful basis for processing patient contact data (e.g. consent, legitimate interest within the therapeutic relationship)
  • Inform the patient in accordance with Art. 13/14 GDPR that PhysioSense stores this data on behalf of the clinical practice
  • Honour the patient's rights (access, rectification, erasure) as data controller

Technical and organisational measures (PhysioSense as processor):

  • Patient contact data is encrypted with AES-256-GCM at the application layer
  • Storage in the EU (Supabase, Ireland). Data is not transferred outside the EEA without appropriate safeguards.
  • Data is permanently deleted together with the clinical record or upon account deletion
  • Sub-processors: Supabase Inc. (Ireland) — data storage; Vercel Inc. (France) — application hosting

For requests relating to patient data rights, the clinician (data controller) is primarily responsible. PhysioSense will support fulfilment of such requests in accordance with Art. 28 GDPR obligations.

7. Intellectual Property

Platform content, including data aggregation, structure, and presentation, is protected by copyright. The PECS classification system is the property of PhysioSense. Original research papers and guidelines belong to their respective authors and publishers.

7b. Fair Use / Fair Dealing

PhysioSense extracts and presents brief quotations from published systematic reviews and guidelines under the provisions on quotation and educational use pursuant to the Montenegrin Law on Copyright and Related Rights, EU Directive 2001/29/EC (Art. 5), and the fair dealing doctrine of applicable law. Such use is transformative (reorganizing evidence by role, phase, and context for educational purposes), limited in scope (brief descriptions of approaches and parameters, not full articles), and non-competitive (does not replace the original sources). All quoted material is attributed to the original authors with PMID and page reference.

8. Data Accuracy & Verification

Every data point on the platform is linked to a PMID, source page, and quoted text from the PDF. PECS (PhysioSense Evidence Classification System) is a proprietary classification system that maps to the GRADE framework, but is not identical to it. PECS labels should not be confused with official GRADE assessments. Extracted data may contain errors — always verify against the original source document.

9. Limitation of Liability

PhysioSense is provided "as is". We do not guarantee that information is complete, accurate, or up to date. We are not liable for any decisions made based on information on the platform. Extracted data goes through multi-layer verification, but errors are possible. Every data point links to the original PDF for independent verification.

9b. Force Majeure

PhysioSense is not liable for service interruptions caused by circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, power outages, internet infrastructure failures, or governmental actions.

9c. Platform Availability

PhysioSense aims to provide continuous service but does not guarantee a specific uptime level. Maintenance and updates may temporarily limit access. For planned maintenance, we will endeavour to notify users in advance.

10. Liability Cap

To the maximum extent permitted by applicable law, PhysioSense's total aggregate liability for any claims arising from or related to the use of the platform shall not exceed the total subscription fees actually paid by the user in the twelve (12) months immediately preceding the event giving rise to the claim. For free-tier users, maximum liability shall not exceed EUR 50.

11. Scope of Practice & Jurisdiction

Content on PhysioSense is filtered by your selected professional role, but scope of practice varies significantly across jurisdictions. Role selection is self-declared and not verified by PhysioSense. You are responsible for ensuring you have appropriate qualifications and licensure to use information from studies in your practice.

Pharmacological information (PharmaSense module) is for educational reference only. Data from published guidelines is displayed — not recommendations. Physiotherapists, chiropractors, and most rehabilitation professionals do not have prescribing authority in most jurisdictions. Users are responsible for adhering to their scope of practice.

Supplement information (SupplementSense module) presents data from regulatory monographs, approved health claims, and published studies. PhysioSense does not recommend or promote supplement use. Drug interactions from published sources are also displayed.

Diagnostic metrics (DiagnosticSense module) display test accuracy values from published studies. Values may differ depending on population, setting, and execution technique. The clinician is responsible for interpretation in the context of their patient.

Emerging therapies (HorizonSense module) display active research and approaches with limited evidence. The information displayed does not constitute a recommendation for use.

12. Termination

You may close your account at any time via Settings > Delete Account. We reserve the right to suspend or close accounts that violate these terms. Upon closure, your personal data is deleted in accordance with our Privacy Policy.

In the event of termination for violation of these terms, no refund will be issued for the remaining subscription period.

12b. Changes to Terms

If we make material changes to these terms, we will notify you by email at least 14 days before they take effect. Continued use of the platform after that period constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of Montenegro. Any disputes arising from the use of the platform shall be subject to the jurisdiction of the courts of Montenegro.

Nothing in these terms affects the statutory rights of consumers under applicable local law.
